This Privacy Policy applies to all personal information collected by Refreshing Value Pty Ltd (ACN: 631 330 642) via located at markberridge.com.au (Website).

1. What is “personal information”?

Under the Privacy Act 1988 (Cth) “personal information” is defined as:

“information or an opinion about an identified individual, or an individual who is reasonably identifiable:

(i) whether the information or opinion is true or not; and

(ii) whether the information or opinion is recorded in a material form or not.”

If the information does not disclose your identity or enable your identity to be ascertained, it will – in most cases – not be classified as “personal information” and will not be subject to this Privacy Policy. This includes the cookies that we collect from your computer when you use the Website. We will not seek to identify you personally from our use of these cookies, even in the unlikely event that was possible.

2. What personal information do we collect?

The personal information that we collect from you will depend on how you use the Website. This may include your name, email, phone number and address.

We do not seek to collect or use sensitive personal information.

3. How we collect your personal information

We may collect personal information from you whenever you directly input such information into the Website, such as signing up to newsletters, making service enquiries or purchasing items.

4. Why we collect your personal information

We may collect personal information to:

  1. deliver direct marketing material or service offerings to you;

  2. deliver purchased items to you (e.g. books);

  3. respond to service or other enquiries; and/or

  4. optimise the Website and service experience of our clients.

We will only use personal information we have collected directly from you for those purposes which you would reasonably expect from us.

We may disclose your personal information to our service providers who maintain our Website, or support the delivery of our service offerings, acting in the normal course of their duties.

Our direct marketing material will include a simple means by which you can elect not to receive further communications from us.

5. Consent to this Privacy Policy

By using our Website, you consent to this Privacy Policy.

6. Access, correction and complaints

Australian Privacy Principle 12 permits you to obtain access to the personal information we hold about you in certain circumstances, and Australian Privacy Principle 13 allows you to correct inaccurate personal information subject to certain exceptions. If this is required, please notify us via the contact details set out below.

Complaints regarding how we maintain the privacy of your personal information will be considered by Refreshing Value Pty Ltd within a reasonable timeframe. We may require further information to understand and address your concerns. If we agree that your complaint is valid, we will take appropriate steps to rectify the problem in consultation with you. If you are dissatisfied with the outcome, you may refer the matter to the Office of the Australian Information Commissioner.

7. Applicability of GDPR

In some circumstances, the European Union General Data Protection Regulation (GDPR) provides additional protection to individuals located in Europe. However, being located in Europe does not on its own entitle protection under the GDPR. As our Website does not specifically target customers located in the European Union and we do not monitor the behaviour of individuals in the European Union, we assess that the GDPR does not apply.

8. Contact details for notices

If you seek access to your personal information or have a complaint about how we maintain the privacy of your personal information under this Privacy Policy, please notify mark@refreshingvalue.com.au.
